The KBL Membership Terms of Service

These Terms of Service (the “Terms”) are between K Bennett Law LLC (“K Bennett Law”), a New Jersey Limited Liability Company and You (“member” or “you” or “your”). Your agreement to these Terms the Privacy Policy, and the execution of your Engagement Agreement is required for you to participate in the KBL Membership Program (the “Program”).

Eligibility to join the Program

To join this Program, you represent that you are, at least, 18 years of age and you have the required power and authority to agree to these Terms. 

Memberships are limited to the states where the attorneys at K Bennett Law are authorized to practice law and represent clients. K Bennett Law has the right to reject anyone applying for membership. If you have a conflict of interest with a current client (as solely determined by K Bennett Law), you will not be able to join the KBL Membership Program.

Acceptance of the Terms

By being a member of the Program, you accept the Terms. If you do not accept the Terms, you are required to terminate your membership immediately.

Attorney-Client Relationship

By joining Program, you are beginning the process of establishing an attorney-client relationship with K Bennett Law. To finalize the process of becoming a client of K Bennett Law, you must (1) complete your onboarding payment and (2) sign your electronic engagement agreement. If you terminate your membership of the Program, the attorney-client relationship will end immediately. 

Changes to the Terms

K Bennett Law may modify these Terms. If a modification is made, K Bennett Law will notify you by email. Any changes to these Terms will apply after the date of the change.

Confidentiality

K Bennett Law has an ethical obligation to keep your information confidential. Unless you provide your express, written permission, your attorney will only communicate with you directly about your legal matters.

Membership Services

Membership services and benefits will correspond with the plan selected by the Member. Below, please find a summary of the membership services by plan level.

    • One monthly business or legal workshop
    • One monthly document review (up to 10 pages)
    • Ann ual business assessment
  2. The Influencer
    • Unlimited scheduled consultations
    • One monthly business or legal workshop
    • One monthly document review (up to 10 pages)
    • Annual business assessment
    • One comprehensive trademark search
    • One attorney-filed trademark application
    • Ongoing guidance on trademark use and enforcement for two trademarks
    • Ongoing USPTO maintenance filings for two trademarks
    • Ongoing Trademark monitoring for two trademarks
    • Unlimited Cease & Desist letters for two trademarks
    • Unlimited Social Media Takedowns for two trademarks
  3. The Ambassador
    • Unlimited scheduled consultations
    • One monthly business or legal workshop
    • One monthly document review (up to 10 pages)
    • Annual business assessment
    • One comprehensive trademark search
    • One attorney-filed trademark application
    • Ongoing guidance on trademark use and enforcement for two trademarks
    • Ongoing USPTO maintenance filings for two trademarks
    • Ongoing Trademark monitoring for two trademarks
    • Unlimited Cease & Desist letters for two trademarks
    • Unlimited Social Media Takedowns for two trademarks
    • One quarterly strategy session
    • One quarterly legal project to include a:
      • (1) business setup,
      • (2) trademark registration, or 
      • (3) customized contract creation.

Program Membership Fees

The Program fees shall be deemed earned when received and will be deposited in the firm’s operating account. The fee is to secure your attorney’s availability over the period covered by the fee. Each month, Member You will be charged automatically at the beginning monthly until you cancel. The Program fees exclude expenses and government filing fees. Should your services require additional expenses or government filing fees, Member will be responsible for paying those fees immediately. 

Additional Services

If you engage K Bennett Law for legal services beyond those provided in the KBL Membership Program, those services will be governed by a separate engagement letter.

Refund Policy

Refunds are given solely at the law firm’s discretion. If you have a question regarding your fees, please email info@kbennettlaw.com.

Ending Your Membership

You may cancel your membership for any reason, at any time, by logging into your account. K Bennett Law also has the right to terminate your membership at any time, for any reason. If your payment cannot be processed, K Bennett Law retains the right to terminate your membership immediately.

No Guarantee

K Bennett Law does not guarantee as to results of any action or action taken on your behalf. All legal advice is provided strictly in an advisory capacity.

Severability

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and such severance shall not affect the validity and enforceability of any remaining provisions.

Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms and your engagement agreement represent the entire agreement and understanding between you and K Bennett Law and govern your use of the products and services. These Terms supersede any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms.)

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

Dispute Resolution

If a dispute arises relating to any aspect of these Terms between Member and K Bennett Law, we strive to settle such disputes through negotiation.  If the dispute cannot be resolved through negotiation, Member agrees, in good faith, to discuss the use of mediation before resorting to arbitration, litigation, or any other dispute resolution procedure. 

Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed by the laws of the state of New Jersey.
